A unified intellectual property body will appear in Ukraine

The Verkhovna Rada supported in the second reading bill No. 2255, which creates the only intellectual property body in Ukraine.

Details: The bill was supported by 245 people’s deputies.

The law provides for the establishment of the National Intellectual Property Authority of Ukraine (NOPA) as a legal entity of public law (state organization).

NOPA will belong to the management sphere of the Ministry of Economic Development, Trade and Agriculture.

According to the explanatory note, the Ministry of Economy will ensure the formation and implementation of state policy in the field of intellectual property, and the NOPA will issue security documents (patents, certificates) for intellectual property.

The functions of the NOPA are performed by the state organization, which will be created on the basis of the state enterprise “Ukrainian Institute of Intellectual Property” (the institution of expertise), and relate to the management of the Ministry of Economy.

It is assumed that the transparency of the NOPA will be ensured through an external audit (financial and managerial), the publication of financial estimates, public monitoring, and the like.

Financing will be provided through fees for actions related to the protection of intellectual property rights.

In addition, according to the explanatory note, this law “does not apply to relations on the implementation of actions related to the protection of intellectual property rights (inventions, utility models, industrial designs, semiconductor product layouts, trademarks (marks for goods and services), geographical indications (indications of the origin of goods), objects of copyright and related rights, registration and accreditation of collective management organizations).
